What to bring
Papers to bring
- Your Indian passport or OCI card (photocopy; the original to show)
- Proof of your address abroad, such as a residence permit, visa or driving licence
- Copies of the Indian papers the affidavit is about: deed, jamabandi (fard), account or case details
- The appointment with the Indian embassy or consulate (some use an outsourced centre), or with the local notary
- Two recent passport-size photographs, if the office asks for them
Where to go
Signed abroad before an officer of the Indian embassy or consulate, or before a local notary and then apostilled (in a Hague Convention country) or attested by the Indian mission; the original is then sent to India.
Fee
The embassy or consulate charges its consular fee, or the local notary and the apostille office charge theirs; in India, stamp duty may be due when the paper arrives. Ask for today's amounts.
Good to know
- Once the affidavit reaches India it usually has to be stamped within three months of its arrival; ask the e-Stamp centre or the Collector.
- Write your name and passport number exactly as in the Indian records, and attach a copy of the passport page.
- To let someone act for you in India, use a power of attorney, not an affidavit (the app has a special power of attorney for NRIs).
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Punjab: affidavits are usually typed on e-stamp paper (buy it at an authorised e-stamp centre; check the current duty there) and sworn before an Oath Commissioner or Notary. Many state services now accept a self-declaration instead.
Haryana: use e-stamp paper (egrashry / authorised vendors; check the current duty) and swear before an Oath Commissioner or Notary.
Chandigarh: e-stamp paper from an authorised centre (check the current duty); sworn before an Oath Commissioner or Notary.
