What to bring
Papers to bring
- Copies of the RTI application, the PIO's reply, the first appeal and the first appellate order (if any), with the fee proof and postal receipts
- An index of the papers, each copy self-attested, as the Commission asks
- Your full address, phone number and e-mail, for the notice of hearing
Where to go
Sent to the Information Commission: the Central Information Commission for central offices and those of the Chandigarh Administration, or the Punjab or Haryana State Information Commission (both in Chandigarh) for state offices. The Central Commission also takes appeals online.
Fee
Usually no fee for a second appeal; ask the Commission whether its rules have changed.
Good to know
- File within 90 days from the date the first appeal was decided or should have been decided (s.19(3)); a late appeal needs good reason.
- The Commission can order the information, compensation and a penalty on the PIO (ss.19(8) and 20); hearings are often held by video.
- Send every paper listed: the Commission may return an appeal with papers missing.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Plain paper is enough.
