What to bring
Papers to bring
- The title papers: the previous registry, the latest jamabandi (fard) and mutation, or the municipal or authority record
- Proof of the relationship: the family register, ration card or Family ID (Haryana), or birth and marriage certificates
- Both parties (or their attorneys), each with a photo identity proof, and the PAN card where the income-tax rules need it for the value
- Two passport-size photographs of each party (the office also takes a photograph and thumb impression)
- Two witnesses with photo identity proof, who sign the deed and identify the parties
Where to go
Registered at the Sub-Registrar's office where the property lies (in Punjab and Haryana usually the Tehsildar or Naib Tehsildar), on a slot booked through the state's online registration appointment where offered; both parties and the witnesses appear in person.
Fee
Many states charge little or no stamp duty on a gift to a relative on the state's list; the registration fee is usually still paid. Ask the Sub-Registrar before buying the e-Stamp.
Good to know
- A gift of land or a house needs a registered deed, and the donee must accept it in the donor's lifetime (ss.122 and 123 Transfer of Property Act).
- Present the deed for registration within four months of signing; later, only for a good reason, within four more months and on a fine.
- After registration, have the mutation entered, or the municipal or authority record changed: see "Mutation (intkal) application".
- A senior citizen who gifts property on a written condition of being looked after can have the gift cancelled by the Maintenance Tribunal if it is broken (s.23 of the senior citizens' Act).
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
