Simran Kaur daughter of Shri Gurdev Singh, aged about 19 years, resident of House No. 88, Model Town, Amarnagar, Tehsil and District Amarnagar, Punjab (hereinafter called the "RELEASOR", which expression shall, unless repugnant to the context, include her heirs, legal representatives and assigns) of the FIRST PART.
AND
Gurdev Singh son of Shri Karnail Singh, aged about 48 years, resident of House No. 88, Model Town, Amarnagar, Tehsil and District Amarnagar, Punjab (hereinafter called the "RELEASEE", which expression shall, unless repugnant to the context, include his heirs, legal representatives and assigns) of the SECOND PART.
NOW THIS DEED WITNESSETH AND THE PARTIES HEREBY AGREE AS UNDER:

What to bring
Papers to bring
- The death certificate of the deceased (photocopy; the original to show)
- Proof that you inherited a share: the inheritance mutation and jamabandi (fard), or a will, succession or legal heir certificate
- Proof of the relationship with the releasee, where a family release pays less duty
- Both parties (or their attorneys), each with a photo identity proof, and the PAN card where the income-tax rules need it for the value
- Two passport-size photographs of each party (the office also takes a photograph and thumb impression)
- Two witnesses with photo identity proof, who sign the deed and identify the parties
Where to go
Registered at the Sub-Registrar's office where the property lies (in Punjab and Haryana usually the Tehsildar or Naib Tehsildar), on a slot booked through the state's online registration appointment where offered; both parties and the witnesses appear in person.
Fee
Stamp duty on a release follows the state's schedule, on the value of the share or a fixed amount; releases within the family often get a concession. The registration fee is extra; ask the Sub-Registrar before buying the e-Stamp.
Good to know
- A release can only be made in favour of another co-owner; to give your share to anyone else, use a sale or gift deed.
- Present the deed for registration within four months of signing; later, only for a good reason, within four more months and on a fine.
- After registration, have the mutation entered, or the municipal or authority record changed: see "Mutation (intkal) application".
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Deeds and agreements carry stamp duty that depends on the state, the document and its value; some must be registered with the Sub-Registrar. Check the current duty and registration rules before printing on stamp paper.
