What to bring
Papers to bring
- The original agreement to sell, to be returned to the seller, and the earnest-money receipts
- Proof of the refund: the bank transfer record, or the cheque or draft details
- Identity proof of the seller and the buyer, with two photographs each
- Two witnesses, each with an identity proof
Where to go
Signed by both on e-Stamp paper before two witnesses. If the agreement to sell was registered, register this deed too, usually at the same Sub-Registrar's office; otherwise many have it attested by a Notary.
Fee
Stamp duty on a cancellation follows the state's schedule; the registration or Notary's fee is extra. Ask the e-Stamp centre for today's amounts.
Good to know
- Once it is signed, neither side can sue on the old agreement, so settle every payment first and refund by bank transfer or cheque.
- If the agreement was noted in the revenue or registry record, have the entry removed after the cancellation.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Deeds and agreements carry stamp duty that depends on the state, the document and its value; some must be registered with the Sub-Registrar. Check the current duty and registration rules before printing on stamp paper.
