What to bring
Papers to bring
- A copy of the FIR or the complaint, and the latest order of the court
- The written settlement, signed by both sides and two witnesses (the original and copies)
- Identity proofs of the complainant and of every accused (the originals to show)
- Any payment under the settlement: the draft or cheque, or proof that it has been paid
Where to go
Filed jointly through the advocates in the trial court; the complainant and every accused usually appear in person to make their statements, and the court records the compounding.
Fee
Court fee and welfare stamps, where needed, are put on as the court office directs; ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- Only offences listed as compoundable in section 359 can be settled this way, some only with the court's permission; for others, see "Petition to quash an FIR on a compromise (s.528 BNSS)".
- A compounding has the effect of an acquittal and cannot be undone later; the court asks each side whether the settlement is free.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
