What to bring
Papers to bring
- A certified copy of the decree, and of the judgment
- An account of what is due: the decree amount, interest and costs, less anything already received
- Details of the judgment-debtor's property for attachment: bank account, salary, land (jamabandi), a house or a vehicle
- The judgment-debtor's present address
- Your identity proof, and a vakalatnama in favour of your advocate, signed by you
Where to go
Filed through your advocate in the court that passed the decree, or the court it is sent to for execution; the court issues notice and then warrants of attachment, sale or possession.
Fee
Court fee and welfare stamps, where needed, and the process fee (talbana) for each notice or warrant, as the court office directs; ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- Execution can usually be sought within 12 years of the decree; a decree for a permanent injunction has no such limit.
- If the judgment-debtor's property is in another district, the court can send the decree there for execution.
- Show every payment already received: claiming more than is due invites objections and delay.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
