What to bring
Papers to bring
- A copy of the FIR, or of the complaint or police notice that makes you fear arrest
- Papers that show your side: agreements, receipts, bank records, messages, and complaints you made earlier
- Your identity proof, and a vakalatnama in favour of your advocate, signed by you
- If bail is granted: each surety (one or two, as ordered) with a photo identity proof, proof of address and two passport-size photographs
- The surety's property papers: a recent jamabandi (fard), a house deed, a vehicle's RC or an FD receipt, as the court accepts
Where to go
Filed through an advocate in the Sessions Court of the district where the case is registered (the High Court can also hear it); the court usually calls for the police record before deciding.
Fee
Court fee and welfare stamps, where needed, as the court office directs; bail bonds are usually on the court's printed form. Ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- Only the court decides bail; no one can promise it. Tell your advocate of every other case and earlier bail application: hiding one can lead to refusal or cancellation.
- If interim protection is granted, join the investigation whenever called and keep every condition, such as not leaving India (s.482(2)).
- Anticipatory bail is not available for some sexual offences against girls under eighteen (s.482(4)); the advocate will tell you.
- For an FIR registered before 1 July 2024, ask your advocate whether the BNSS or the old Code (CrPC) applies to this application.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
