AFFIDAVIT
(Legal heirs)
I, Gurdev Singh son of Shri Karnail Singh, aged about 48 years, resident of House No. 88, Model Town, Amarnagar, Tehsil and District Amarnagar, Punjab, do hereby solemnly affirm and declare as under:
1.That Jagir Singh died on 19-06-2021 at Village Kalyanpur.
2.That the deceased is survived by the following legal heirs only:
(a)Balwant Kaur, widow, aged 67 years;
(b)Gurdev Singh, son, aged 48 years;
(c)Manjit Kaur, daughter, aged 44 years;
3.That apart from the above, the deceased has left no other legal heir, and none of the heirs has been disowned.
4.That I am one of the legal heirs, and I am making this affidavit so that the records may be changed in the names of the legal heirs.

DEPONENT
What to bring
Papers to bring
- The death certificate of the deceased
- Identity proof of the deponent and of every heir (photocopies)
- Proof of each relationship: the family register, ration card or Family ID (Haryana), and birth and marriage certificates
- The death certificate of any heir who has also died
- The record to be changed: the passbook or account details, the pension papers, or the jamabandi (fard)
- Two witnesses who know the family, with identity proof, where the office asks
Where to go
Sworn before an Oath Commissioner or Notary, then given to the bank, pension office or other office with its own claim form. For land, the Patwari enters the inheritance mutation and the revenue officer attests it (the app has an affidavit for that).
Fee
The e-Stamp paper and the attestation fee are paid at the counter; the bank, pension office or tehsil may charge its own fee. Ask for today's amounts.
Good to know
- Name every heir: under the Hindu Succession Act, which also covers Sikhs, Jains and Buddhists, a man's widow, mother and daughters (married or not) inherit along with his sons.
- For larger amounts, or where the heirs disagree, banks and offices may ask for a succession certificate or a court order instead.
- If the deceased left a will, this affidavit may not be enough; ask a lawyer.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Punjab: affidavits are usually typed on e-stamp paper (buy it at an authorised e-stamp centre; check the current duty there) and sworn before an Oath Commissioner or Notary. Many state services now accept a self-declaration instead.
Haryana: use e-stamp paper (egrashry / authorised vendors; check the current duty) and swear before an Oath Commissioner or Notary.
Chandigarh: e-stamp paper from an authorised centre (check the current duty); sworn before an Oath Commissioner or Notary.
