What to bring
Papers to bring
- A copy of the FIR
- The written compromise signed by both sides and witnesses (the original and copies)
- The complainant's affidavit that the compromise is voluntary, if the advocate asks for it
- Identity proofs of every accused and of the complainant
- The latest order of the trial court, or the challan, if filed
Where to go
Filed through an advocate at the filing counter of the Punjab and Haryana High Court, Chandigarh; the advocate signs it and files the vakalatnama.
Fee
Court fee stamps and the welfare stamp go on the petition and the vakalatnama as the High Court rules direct; ask the filing counter for today's amounts. The advocate's fee is separate.
Good to know
- The High Court usually sends both sides to the trial court or the Illaqa Magistrate to record statements; every accused and the complainant must go in person.
- Serious offences such as murder, rape or dacoity are usually not quashed on a compromise; ask the advocate first.
- The High Court works in English: the advocate files the English version, and any paper in Hindi or Punjabi usually needs a typed English translation.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
High Court: court fee stamps (or an e-court-fee receipt) and the welfare stamp go on the petition and the vakalatnama as the High Court rules and its filing counter direct; ask there for the current amounts.
