IN THE COURT OF Civil Judge (Junior Division), Amarnagar
Civil Suit No. 412 of 2025
Versus
APPLICATION UNDER ORDER VI RULE 17 CPC FOR AMENDMENT OF THE PLAINT
Respectfully Showeth:
1.That the applicant wishes to amend the plaint as follows:
(a)to add a prayer for mesne profits from 01-01-2025;
2.That the amendment is necessary to decide the real controversy between the parties, does not change the nature of the case, and could not be sought earlier despite due diligence because the defendant stopped paying rent only after the suit was filed.
3.That the opposite party will not be prejudiced and can be compensated by costs.
PRAYER:
It is, therefore, respectfully prayed that the applicant may kindly be allowed to amend the plaint as proposed above.
Any other relief which this Hon'ble Court deems fit may also be granted in the interest of justice.

What to bring
Papers to bring
- The main case: its number and year, the court, the names of the parties and the next date
- A copy of the plaint or written statement as filed, with its paragraph numbers
- The changes you want, paragraph by paragraph (the old words and the new), and the papers behind any new fact
- The supporting affidavit: see "Affidavit in support of a plaint or application"
Where to go
Filed through your advocate in the court where the suit is pending; the other side gets a copy and may reply. If allowed, the amended pleading is filed by the date the court fixes.
Fee
Court fee and welfare stamps, where needed, are put on as the court office directs; ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- After the trial has begun, an amendment is allowed only if you show that, despite due diligence, you could not have raised it earlier.
- If the amendment raises the value of the claim, the extra court fee is paid on the amended plaint; the court may also order costs.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
