What to bring
Papers to bring
- The vehicle's registration certificate (RC) and insurance (photocopies; the originals to show)
- A copy of the FIR and of the seizure memo, if you have them
- For a vehicle on loan, the financier's no-objection letter
- The supporting affidavit: see "Affidavit for release of a vehicle or articles on superdari"
- Your identity proof, and a vakalatnama in favour of your advocate, signed by you
Where to go
Filed through your advocate in the Magistrate's court where the case is; the court calls for the police report, then orders release on a superdari bond, usually after the vehicle is photographed.
Fee
Court fee and welfare stamps, where needed, as the court office directs; the superdari bond is usually on the court's form, sometimes with a surety. Ask the counter for today's amounts.
Good to know
- Produce the vehicle whenever the court asks, and do not sell, alter or transfer it until the case ends; the court passes the final order on it after the trial.
- Under some laws, such as the excise or NDPS laws, other rules apply to seized vehicles; ask your advocate.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
