What to bring
Papers to bring
- The death certificate of the deceased (photocopy; the original to show)
- A recent copy of the jamabandi (fard) of the land, from the Fard Kendra or the Patwari
- Identity proof of the deponent and of every heir (photocopies)
- Proof of the relationship: the family register, ration card or Family ID (Haryana), or birth and marriage certificates
- The death certificate of any heir who has also died
- Two respectable persons of the village who know the family, such as the numberdar or sarpanch, if the Patwari asks
Where to go
Sworn before an Oath Commissioner or Notary, then given to the village Patwari, or at the Fard Kendra, with the application for mutation of inheritance (the app has a mutation application). The Patwari enters the mutation, and the revenue officer attests it, usually after hearing the heirs in the village or at the tehsil.
Fee
The tehsil charges its mutation fee, and the Fard Kendra a fee for each jamabandi copy; the e-Stamp paper and the attestation fee are paid at the counter. Ask for today's amounts.
Good to know
- Name every heir with the share the law gives: under the Hindu Succession Act, which also covers Sikhs, Jains and Buddhists, a man's widow, mother and daughters inherit along with his sons.
- Report the death to the Patwari soon: the Land Revenue Act asks heirs to report it within three months.
- A mutation only updates the revenue record; it does not decide title, and a dispute goes to the civil court.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
