What to bring
Papers to bring
- Proof that you own the building: the sale deed, jamabandi (fard) or mutation, allotment letter, or the property-tax record
- Proof of the tenancy: the rent deed or agreement, rent receipts or the bank record of rent paid
- Proof of each ground: the account of unpaid rent and any notice sent; for your own need, who needs it and where you live now; for an unsafe building, the municipal notice or an engineer's report
- The tenant's full name, father's or husband's name and address, and a site plan of the premises if you have one
- Your identity proof, and a vakalatnama in favour of your advocate, signed by you
Where to go
Filed through an advocate before the Rent Controller of the urban area where the building is (a Civil Judge usually acts as Rent Controller), with the supporting affidavit.
Fee
Court fee and welfare stamps, where needed, are put on as the court office directs; ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- On the ground of unpaid rent, the tenant can still avoid eviction by paying the arrears with interest and the costs on the first date of hearing, as the Act provides.
- Never lock the premises, remove goods or cut water or electricity to force the tenant: that is unlawful.
- An NRI landlord in Punjab may have a quicker route under section 13-B of the Act; ask your lawyer.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee on a plaint, petition or appeal depends on the relief and its valuation under the state's court-fee law; affix the court-fee stamps (or the e-court-fee receipt) and any welfare stamps as the court office directs.
