What to bring
Papers to bring
- A certified copy of the latest jamabandi (fard) of the joint khewat
- The field map (aks shajra) of the khasra numbers, from the Patwari
- A list of all the co-sharers with their full addresses, as in the jamabandi
- The death certificates and inheritance mutations of co-sharers who have died, so that their heirs are named
- Your identity proof, and a vakalatnama if an advocate files it for you
Where to go
Filed before the Assistant Collector of the tehsil where the land lies (a Tehsildar or Naib Tehsildar, as the state has empowered), often through an advocate. Notices go to every co-sharer, the mode of partition is framed after hearing them, and the land is then divided on the spot.
Fee
A court-fee stamp on the application and the process fee for the notices to the co-sharers, as the office directs; ask there for today's amounts. The advocate's fee, if any, is separate.
Good to know
- Leaving out a co-sharer delays the case: check the list against the jamabandi.
- If a co-sharer disputes the title or the shares, the revenue officer may decide it or leave it to the civil court; ask an advocate.
- Co-sharers who agree can divide by a registered "Partition deed"; a house or plot is usually divided by "Suit for partition and separate possession".
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
