What to bring
Papers to bring
- Proof of the owner's title to the site: the registry or allotment letter, and the jamabandi (fard) or property-tax record
- The building plan sanctioned by the municipal committee or development authority, and the drawings and estimate the work follows
- The contractor's identity proof, PAN, GST registration if any, and bank details
- The payment stages, the finish date and the materials and brands agreed
- Two witnesses, each with an identity proof
Where to go
Signed by the owner and the contractor before two witnesses, usually on e-Stamp paper of the value the state fixes (some states charge a works contract by its value); notarising it is optional. It is not registered.
Fee
The e-Stamp duty follows the state's schedule; ask the e-Stamp centre for today's amount. Fees for the building plan, and the construction workers' welfare cess where it applies, are paid to the authority separately.
Good to know
- Start only after the building plan is sanctioned: building against the plan can lead to a fine or demolition.
- Pay stage by stage against the work done, by bank transfer, and take a receipt for each payment.
- Take photographs at each stage, and agree any extra work and its rate in writing before it is done.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Deeds and agreements carry stamp duty that depends on the state, the document and its value; some must be registered with the Sub-Registrar. Check the current duty and registration rules before printing on stamp paper.
