VEHICLE SALE AGREEMENT

AND
Anil Verma son of Shri Ramesh Verma, aged about 31 years, resident of House No. 204, Sector 9, Shantipur, District Shantipur, Haryana (hereinafter called the "BUYER", which expression shall, unless repugnant to the context, include his heirs, legal representatives and assigns) of the SECOND PART.

What to bring
Papers to bring
- The original RC, the insurance policy, the pollution (PUC) certificate and all the keys
- Identity and address proof of the seller and the buyer (Aadhaar, for the online transfer on Vahan)
- Forms 29 and 30, signed by the seller and the buyer
- If there is a loan on the vehicle: the financier's no-objection certificate and Form 35, or the loan account's details if it is still running
- Proof of the price paid: the bank transfer record, or the cheque or draft number
- Two witnesses, each with an identity proof
Where to go
Signed by the seller and the buyer before two witnesses, usually on e-Stamp paper, and often attested by a Notary; it is not registered. The RC is then transferred on the Vahan portal (parivahan.gov.in) and at the registering authority (the RTA, or the SDM's registration office).
Fee
The e-Stamp duty follows the state's schedule for agreements and the Notary's fee is paid at the counter; the transfer fee and any tax due are paid online on Vahan. Ask for today's amounts.
Good to know
- Write the exact date and time of the hand-over: challans and accidents before it are the seller's, after it the buyer's.
- Within the same state, the seller reports the sale within 14 days and the buyer applies for the transfer within 30 days (Motor Vehicles Act, section 50).
- Have the insurance policy transferred to the buyer too; until Vahan shows the new owner, challans may still reach the seller.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Many buyers have it notarised; the RC transfer itself is done on Forms 29 and 30 at the transport office.
