WITNESSES:
What to bring
Papers to bring
- Aadhaar card or another photo identity proof (photocopy; the original to show)
- The settlement or compromise papers, and the number of any pending case or complaint about the matter
- Proof that the money reached you: a copy of the cheque or draft, and your bank statement
- Two witnesses, each with an identity proof
Where to go
Signed by you before two witnesses and given to the other party; it is attested by a Notary only if that party or an office asks.
Fee
Many offices accept an undertaking on plain paper; if the office asks for stamp paper or attestation, the e-Stamp paper and the Notary's or Oath Commissioner's fee are paid at the counter.
Good to know
- Sign only after the money is actually in your account: a cheque can bounce.
- Make sure it covers only the matter settled, and nothing else.
- This undertaking alone does not close a case in court: it must be withdrawn or compromised there (see "Joint compromise statement").
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
