What to bring
Papers to bring
- Identity proof of every party signing (photocopies; the originals to show)
- The terms agreed, in writing, with amounts, dates and how each payment is made
- Cheques or drafts to be handed over under the compromise, and the property details if land or a house is involved
- The main case: its number and year, the court, the names of the parties and the next date
Where to go
Both parties sign it and usually appear in court (or before the Lok Adalat or the mediation centre) to make their statements; the court records the compromise and decides the case in its terms.
Fee
No court fee is usually needed on the compromise; if the case is settled in a Lok Adalat or through mediation, ask whether the court fee paid can be refunded.
Good to know
- Read every term before signing: a compromise decree binds you like any decree and is hard to undo.
- Say what happens if a party does not pay or act on time; a compromise that also covers land outside this case may need a registered deed, so ask your lawyer.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
