What to bring
Papers to bring
- A certified copy of the document you challenge (from the Sub-Registrar's office if it is a registered deed), or of the order that denies your right
- Proof of your right: title deeds, jamabandi (fard) and mutation, or the record of the post, status or relationship you claim
- Earlier orders, notices and letters between the parties about the matter
- Each defendant's full name, father's or husband's name and present address, for the summons
- Your identity proof, and a vakalatnama in favour of your advocate, signed by you
Where to go
Filed through an advocate in the civil court of the area where the property lies or the defendant lives, with the supporting affidavit.
Fee
Court fee under the state's court-fee law on the value of the declaration and the further relief (to cancel a document you signed, it may be on its value), as the counter or your lawyer confirms, and the process fee for the summons.
Good to know
- Ask for the further relief too (injunction or possession): a bare declaration is refused if you could have asked for more.
- A declaration is usually sought within three years of when your right was first denied; to cancel a document, within three years of learning the facts.
- Suing the government or a public officer for an official act needs two months' notice first: see "Notice to the government (s.80 CPC)".
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee on a plaint, petition or appeal depends on the relief and its valuation under the state's court-fee law; affix the court-fee stamps (or the e-court-fee receipt) and any welfare stamps as the court office directs.
