What to bring
Papers to bring
- The postal receipts and the tracking report printed from the India Post website, or the courier receipt
- The AD card signed by the receiver, or the returned envelope (unopened) marked refused or not found
- For service by hand, the copy signed by the person who received it; for e-mail, a printout showing the date and the address
- A copy of what was served (notice, application or petition)
- The main case: its number and year, the court, the names of the parties and the next date
Where to go
The person who did the service swears it before the Oath Commissioner at the court complex; your advocate files it in the case, under its number, before the date fixed.
Fee
An affidavit made only to be filed in a court is usually free of stamp duty, and no court fee is needed unless the court-fee counter says so; the Oath Commissioner's fee is paid at the counter. Ask there for today's amounts.
Good to know
- Serve at the address in the court record; if the other side has moved, say so and give the new address.
- Keep the original receipts safe and file copies, unless the court asks for the originals.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Punjab: affidavits are usually typed on e-stamp paper (buy it at an authorised e-stamp centre; check the current duty there) and sworn before an Oath Commissioner or Notary. Many state services now accept a self-declaration instead.
Haryana: use e-stamp paper (egrashry / authorised vendors; check the current duty) and swear before an Oath Commissioner or Notary.
Chandigarh: e-stamp paper from an authorised centre (check the current duty); sworn before an Oath Commissioner or Notary.
