IN THE COURT OF Principal Judge, Family Court, Shantipur
HMA Petition No. 88 of 2026
AND
JOINT APPLICATION FOR WAIVER OF THE PERIOD OF SIX MONTHS UNDER SECTION 13-B(2) OF THE HINDU MARRIAGE ACT, 1955
Respectfully Showeth:
1.That the first motion was recorded on 05-10-2026. The petitioners have been living separately since 01-06-2024, so the period of one year and six months had already passed before the first motion.
2.That all efforts at mediation and conciliation have failed: two sittings at the Family Court mediation centre, on 12-08-2026 and 26-08-2026. There is no chance of the petitioners living together again.
3.That the petitioners have genuinely settled all their differences, including alimony, stridhan and custody, and the settlement has been acted upon: ₹3,00,000 paid at the first motion; the rest is ready by demand draft.
The rest of the paper is in Dastavo.
What to bring
Papers to bring
- The petition number and the date the first motion was recorded (a copy of that order, if the court asks)
- Proof of the date you began living apart (a year and a half or more before the first motion): a rent deed, letters, or earlier case papers
- Proof that mediation failed: the mediation centre's report or the counsellor's note
- Proof that the settlement has been carried out: bank-transfer records, receipts or drafts for the amounts paid, and the signed list of the stridhan returned
- Both spouses' Aadhaar cards or other photo identity proofs, with proof of the present address (photocopies; the originals to show)
Where to go
Filed jointly in the same Family Court under the petition's number, usually a week or more after the first motion; both spouses usually appear when it is heard.
Fee
Court fee and welfare stamps, where needed, are put on as the court office directs; ask the counter for today's amounts. The advocate's fee is separate.
Good to know
- The court waives the wait only when the Amardeep Singh conditions are met (a year and a half apart, mediation failed, everything settled, including custody); it may refuse.
- If it is refused, the second motion is moved after the six months in the usual way.
Papers and fees can change. Check with the office before you go. Guidance only, not yet reviewed by a lawyer.
Stamp paper
Court fee and welfare stamps, where needed, are affixed as the court office directs.
